When search was done highways response was: ‘In relation to access although the areas highlighted are not recorded on the Definitive Map of registered public rights of way , there is a strong possibility that the passageway as gained prescriptive public rights through usage under the Highway Act.’

Land registry title shows the bit of land/lane in front of coach house on, no other properties have access to this lane -its the end of the gardens of 3 pair victorian semis which access the road in front of semis.

Our solicitor is still trying to clarify right of access. The original owner (sold 2007) sold it with a written declaration of use which we are going to look at today. How can we be assured we have right of access? The property comes with planning to rebuild house & garage.
