INTERPRETATION

In these Terms and Conditions, the following words and phrases shall bear the following meanings:

• "Material" means data or information in any format, including without limitation text, images, photographs, graphics, video or sound material whether existing at the time of registration or not, published on www.homebuilding.co.uk, whether copyright of Ascent or of a third party and which is communicated or transmitted to the User in using www.homebuilding.co.uk.

•  “www.homebuilding.co.uk” is a product owned and operated by Ascent Publishing Ltd ('Ascent'), whose registered office is at St. Giles House, 50 Poland Street, London, W1F 7AX; and whose ultimate parent company is Centaur Media plc (“Centaur”).

• "User" means any person who accesses or uses www.homebuilding.co.uk.


INTRODUCTION

1. By accessing or using www.homebuilding.co.uk the User acknowledges and agrees to be bound by these Terms and Conditions.

2. The User agrees to fully comply with these Terms and Conditions, including the acceptance of liability as detailed in clauses 4, 5 and12. If the User does not wish to be bound by them he/she should leave the site now and not use this website in the future.

3. Each User is allocated a unique user ID and chooses a password for the authorised use of the User only. These are not transferable, and the User shall keep them strictly confidential and secure. The User should notify Ascent immediately if any unauthorised use comes to its attention.

4. The User shall indemnify Ascent against any unauthorised use of his/her user ID and password, including use by a third party where the User has allowed or facilitated that third party to have access to any Material, however so received.

5. The User shall indemnify Ascent against all costs, claims, demands or expenses incurred by or made against Ascent www.homebuilding.co.uk as a result of any breach of these Terms and Conditions or howsoever arising.


SUBMITTING MATERIAL TO WWW.HOMEBUILDING.CO.UK

6. In order to submit material to www.homebuilding.co.uk the User must register as a personal user via the unique user ID and password at clause 3. The User undertakes not to maliciously create additional registration accounts for the purpose of abusing the functionality of the site, or other users; nor to seek to pass its self off as another user.

7. Ascent reserves the right to prohibit access by person(s) to www.homebuilding.co.uk at its sole discretion at which time the agreement will terminate.

8. The submission of Material by the User is on the following terms

8.1 The User grants Ascent a non-exclusive, non-transferable, perpetual, royalty-free, worldwide licence to publish or use the Material in any format, including in other products of Ascent. The licence shall include the right for any Users to take actions in accordance with clause 10.

8.2 The User warrants to Ascent that all rights including intellectual property and moral rights in the Material submitted belong to the User or the User has received all necessary permissions to submit it to Ascent.

8.3 The User warrants to Ascent that the Material submitted is not obscene, offensive, or defamatory of any person or otherwise illegal.

8.4 Ascent at its sole discretion reserves the right to not publish the Material in part or whole, make additions or deletions to, edit, crop or arrange the Material prior to publication. Ascent may do so without giving any reason but the User should note that Material that is off-topic or unnecessarily antagonistic is likely to be rejected.

8.5 Ascent shall make no payment for Material submitted and used under these Terms and Conditions

9. The User will find the Terms and Conditions for purchases, including subscriptions, on www.subscribetoday.co.uk .

CONDITIONS OF USE

10. Subject to clause 19 the User may download the Material electronically; print extracts and make copies of these for its own personal and non-commercial use only. This does not include downloading, storing, transmitting, displaying, copying or distributing the Material, or extracts from it, in a structured manner or creating a database in any form comprising all or part of the Material.

DATA PROTECTION AND PRIVACY POLICY

11. Ascent takes the privacy of its Users seriously. It is committed to safeguarding the privacy of its Users. Please refer to Ascent’s Privacy Policy (see bottom of page).

LIABILITY

12. The User acknowledges that any breach of clause 8 may cause damage or loss to Ascent and agrees to indemnify Ascent in full against any third party liabilities, claims, costs, loss or damage including consequential losses, incurred as a result of publishing Material submitted.

13. To the extent permitted by law Ascent, its agents or representatives shall have no liability whatsoever to the User for any direct, indirect or consequential loss or special loss or damage, cost or expense suffered or incurred by the User (whether arising in tort, contract or otherwise, and whether arising from the negligence, breach of contract, defamation, infringement of copyright or other intellectual rights) caused by use of www.homebuilding.co.uk or from the negligence of its employees or agents or licensors, and whether asserted against Ascent, www.homebuilding.co.uk or against any third party in relation to its use.

14. Ascent does not make any representation or give any warranty, either express or implied:

14.1 in relation to any information, goods or services offered, accessed or obtained through www.homebuilding.co.uk;

14.2 in relation to warrantees of title, non infringement of copyright or patent rights of others, merchantability, or fitness or suitability for any purpose;

14.3 for the content, accuracy, integrity, lawfulness or otherwise of information on websites over which Ascent has no control;

14.4 as to the suitability of the information and data on www.homebuilding.co.uk for any particular purpose;

14.5 as to the accuracy of the description of any goods;

14.6 that the information and data on www.homebuilding.co.uk site is free of infection by computer viruses or other contamination.

15. Ascent and its agents or representatives do not endorse or in any respect warrant any third party products or services by virtue of any advertisement, information, material or content referred to, or included on, or linked from or to www.homebuilding.co.uk.

16. www.homebuilding.co.uk does not purport to provide advice. Ascent is not responsible for Users taking or refraining from taking actions on the basis of information provided by www.homebuilding.co.uk.

17. Although every care is taken in the preparation of information supplied by www.homebuilding.co.uk, Ascent is not responsible for any loss suffered as a result of any action taken or refrained from being taken as a result of any information contained in www.homebuilding.co.uk.

TRADE MARKS AND INTELLECTUAL PROPERTY


18. All rights in “Homebuilding & Renovating”, and “www.homebuilding.co.uk”, and content displayed on www.homebuilding.co.uk are owned by or licensed to Ascent and are reserved.

19. All Material other than submitted by Users on www.homebuilding.co.uk is property of Ascent. Reproduction without Ascent’s permission is prohibited. For such permission, Users should contact the Editor.

MISCELLANEOUS

20. Users who wish to advertise on www.homebuilding.co.uk should contact the Sales team.

21. Ascent reserves the right to remove, alter, change or vary www.homebuilding.co.uk at any time without notice.

22. Ascent shall endeavour to provide constant, uninterrupted access to www.homebuilding.co.uk but do not guarantee to do so and accept no responsibility or liability for any interruption or delay.

APPLICABLE LAW AND JURISDICTION

23. The provision of www.homebuilding.co.uk is governed by the Laws of England and shall be subject to the jurisdiction of the English courts.

VARIATION

24. Ascent reserves the right to vary or amend these Terms and Conditions at any time without notice. Users should review these Terms and Conditions regularly as Users will be deemed to have accepted a variation in continuing to use the site after it has been posted.

Ascent Publishing Ltd (“Ascent”) will use the information provided by you in the course of our dealing with you to process your requests and orders and in order to provide a more personalised web-surfing experience.

COMPETITION TERMS & CONDITIONS

  1. These rules apply to all prize promotions including free draws, prize competitions and instant win offers. Depending on the nature of the competition there may be additional rules. Promotions are open to UK residents aged 18 and over, except employees of Centaur Special Interest Media, the competition promoter and their immediate families, the promoters advertising agency and sales promotion consultancy, and anyone else connected with the creation and administration of the promotion.
  2. Prizes are non-transferable, non-negotiable and no cash alternatives will be offered. Centaur and the promoter reserve the right to substitute the prize for another prize of equal value.
  3. No purchase necessary to enter the competitions unless otherwise stated on the promotional activity with a specific competition.
  4. By entering the prize draw, the entrant agrees to be bound by the rules and by any other requirements set out in the promotional material accompanying the promotion.
  5. By entering the promotion, the entrant agrees to the terms of the privacy policy. In addition, Centaur Special Interest Media may pass your personal information to the promoters and their data processors if you are opted-in to this service. However, we always demand that those parties adhere to the same security procedures that we follow ourselves.
  6. It is assumed that by entering competitions which, if won, could result in time off work, your employer is in agreement to time off. When dates are specified they cannot be altered. Depending on the nature of the prize, its use or enjoyment may be subject to further conditions or restrictions.
  7. Winners will be notified by email within 5 days of the day of the draw (unless otherwise specified). Where required in the terms of the competition, winners will have 21 days to respond in full to the email, or another winner will be drawn.
  8. By entering the promotion, the winner(s) consent(s) to any publicity generated as a result of the promotion, and for this to be used on the Homebuilding & Renovating website or within the magazine at any time.
  9. The website Editor's decision is final and no correspondence will be entered into. Odds of winning depend on the number of eligible entries received.
  10. Only one entry per person. Spammers will be disqualified.
  11. Homebuilding & Renovating will not accept responsibility for loss through technical fault, incomplete, illegible or other damaged entries.
  12. Proof of postage/entry will not be accepted as proof of receipt.
  13. Postal entries will not be accepted for online only competitions.
